The Board of Education voted to consider firing Freshwater in 2008 on the grounds of his conduct and teaching materials. He requested a public administrative hearing, pursuant to Ohio Revised Code 3319.16, which began in October 2008. The referee overseeing the termination hearing submitted his recommendation to terminate Freshwater's teaching contracts to the Board of Education in January 2011. The Board terminated Freshwater's contracts on January 10, 2011 after the nearly two-year hearing, which cost the district more than $900,000, while Freshwater himself was suspended without pay over the same period.
